Residence of a Family Member of a Polish Citizen

TEMPORARY RESIDENCE PERMIT

A temporary residence permit for family members of a Polish citizen is granted:

  • a foreign national who is the spouse of a Polish citizen
  • minor children of the spouse of a Polish citizen who holds a temporary or permanent residence permit granted to a family member of a Polish citizen and is married to that citizen

Important!

In the event of divorce or separation, when the foreign national’s important interest so warrants, or in the event of the death of a spouse or a parent of a minor child, a subsequent permit of this type may be granted to the foreign national on a one-time basis for a period not exceeding 3 years.

This application may also be filed by individuals who reside together in the territory of the Republic of Poland and lead a family life, as defined by the Convention for the Protection of Human Rights and Fundamental Freedoms, with a Polish citizen residing in Poland.

It is important to know that this type of permit may also be granted to other family members of a Polish citizen if they are residing in Poland:

  • due to serious health reasons that require personal care from this Polish citizen
  • if the foreign national lives in the same household as a Polish citizen or is financially dependent on that citizen in the country from which the foreign national arrived

When applying for a temporary residence permit, the spouse and minor children of a Polish citizen are not required to demonstrate a stable and regular source of income, a guaranteed place of residence in Poland, or health insurance. Nor is the Polish citizen with whom the foreign national is residing in Poland required to do so.

PERMANENT RESIDENCE PERMIT

A permanent residence permit may be granted to a foreign national who:

  • has been married, in a marriage recognized by the law of the Republic of Poland, to a Polish citizen for at least 3 years prior to the date on which he or she filed an application for a permanent residence permit and
  • resided continuously in the territory of the Republic of Poland immediately prior to submitting an application for a permanent residence permit, for a period of not less than 2 years on the basis of a temporary residence permit granted in connection with being married to that Polish citizen (Article 158(1)(1) of the Act on Foreigners) or in connection with having been granted refugee status, subsidiary protection, or a residence permit

Important!

If a foreign national divorces within 2 years of the date on which a permanent residence permit was granted to him or her, the permanent residence permit may be revoked.

ACQUISITION OF POLISH CITIZENSHIP THROUGH MARRIAGE

Important!
Polish citizenship is not granted immediately upon the marriage of a foreign national and a Polish citizen.

The following persons may apply for recognition as a Polish citizen:

  • a foreign national who has resided continuously in the territory of the Republic of Poland for at least 2 years on the basis of a permanent residence permit, a long-term resident’s permit issued by the European Union, and
  • a foreign national who has been married to a Polish citizen for at least 3 years.
