A Family Vacation

Foreign nationals who are eligible to receive a temporary residence permit as family members of a foreign national residing in Poland include:

  • spouse, whose marriage must be recognized under Polish law
  • a minor child (under 18 years of age)—whether biological or adopted—or any other child who is dependent on the foreign national and over whom the foreign national exercises actual parental authority (e.g., a spouse’s child from a previous relationship)

Family members of a foreign national residing in Poland may apply for a temporary residence permit for the purpose of family reunification if the foreign national is residing in Poland:

  • based on an EU long-term resident permit;
  • based on a permanent residence permit;
  • based on a temporary residence permit for the purpose of working in a profession requiring high qualifications (the so-called Blue Card);
  • for at least 2 years on the basis of successive temporary residence permits, including a permit granted to him for a period of residence of no less than 1 year immediately prior to filing the application for a temporary residence permit for a family member;
  • based on a temporary residence permit for the purpose of working as part of an intra-company transfer;
  • based on a temporary residence permit granted for the purpose of long-term mobility;
  • in connection with the granting of subsidiary protection to him;
  • in connection with his being granted refugee status;
  • in connection with the granting of a residence permit on humanitarian grounds;
  • based on a temporary residence permit for the purpose of conducting scientific research;
  • on the basis of a temporary residence permit for the purpose of conducting scientific research, issued by another European Union member state, provided that the foreign national holds a residence permit referred to in Article 1(2) of Council Regulation No. 1030/2002, bearing the annotation “researcher,” provided that the agreement on the admission of the foreign national for the purpose of carrying out a research project, concluded with the relevant research institution of that country, also provides for the conduct of scientific research on the territory of Poland.

Important!

An application for a temporary residence permit for the purpose of family reunification may be filed by a foreign national (a parent or spouse) residing in Poland if the family member is outside Poland.

In such a case, it is important to remember that submitting the application requires the written consent of the foreign national residing outside Poland. This consent should be accompanied by a power of attorney authorizing the representative to act on behalf of the family member in the proceedings in question.

After a decision granting a temporary residence permit has been issued, a foreign national residing in Poland may provide it to a family member so that the family member can use it to obtain a visa to Poland in their home country at the appropriate embassy or consulate of the Republic of Poland. A family member may collect the residence card only in person in Poland.

Important!

If a foreign national, who is being joined by a family member, does not meet the above-mentioned conditions (e.g., the foreign national is staying in Poland under a temporary residence permit for a period of less than 2 years or under a visa), the family member may apply for a temporary residence permit issued on the basis of other circumstances.
